Bob McNally presented a paper to the Alberta Expropriation Association Annual Conference in Canmore , Alberta on October 1, 2004. The paper titled, Quantifying a Loss on a Business Expropriation or a Permanent Impairment of Value Relating to a Public Work, reviewed key aspects of how to quantify the compensation due to a business that has either had property expropriated or suffered a permanent impairment of market value because of the construction of a public work by a municipality. The paper focused on key valuation issues including; the importance of the valuation date, commercial versus personal goodwill, redundant assets and the valuation of shares versus assets. The paper also reviewed how a business valuator can play a central role in determining whether or not the action of the Defendant was the cause of the permanent impairment of market value.
The paper has been published on The Expropriation Law Centre web site and can be found on the article page under the title Quantifying a Business Loss.
